1.1 This website is operated by Keith Bound (“KB”). By visiting the website, you agree to be legally bound by these terms as they may be modified and posted on this website from time to time.  
1.2 Without prejudice to the above, by using or accessing the website, you agree to be legally bound by these terms of use as they apply to your use of or access to this website.    
1.3 If you do not wish to be bound by these terms then you may not use the website.  
1.4 Read Privacy statement concerning data protection (Data Protection Act 2018. The Data Protection Act 2018 is the UK’s implementation of the General Data Protection Regulation (GDPR).

2. Nature of this website    
2.1 The website is a place for you to see information about KB, services he can provide. You can order storytelling consulting services which will be referred to as the advertised services (“the Services”). This website describes Services in more detail. You will be asked to accept the terms under which KB sells any Services which you will find set out through this website” when ordering any of the Services. 
   
3. Modifications to website  
3.1 KB will make reasonable efforts to ensure the storytelling consulting services are completed within the arranged time and date as stipulated within a contract; however, KB cannot be held responsible project deadlines are cancelled/rearranged due to illness, other cause or due technical fault by third party service.  
3.2 It is your responsibility to provide client requirements, which have agreed time and date. If for any reason you need to cancel storytelling consultancy services during a contract period you will incur the full charges of the contract, which will need to be paid within 7 working days of cancellation.

 

4. Information you provide to us  
4.1 The following applies to any information you provide to us, for example during contractual discussions.  You authorise KB to use, store or otherwise process any personal information which relates to and identifies you, including but not limited to your company name and address, to the extent reasonably necessary to provide the Services which are available through the website by KB. If you would like to request such information or review or modify any part of your personal information, then you can contact KB. You must ensure that the Personal Information you provide is accurate and complete and that all ordering or registration details (where applicable) contain your correct name, address and other requested details. 4.2 By accepting these terms, you agree to the processing and disclosure of the Personal Information for the Purposes. If you would like to review or modify any part of your Personal Information, then you should e-mail KB.    
4.3 You warrant and undertake that you will not use the website for any purpose that is illegal or prohibited by these terms, including without limitation the posting or transmitting of any libelous, defamatory, inflammatory or obscene material. If you breach these terms, then your permission to use this website terminates immediately without the necessity of any notice being given to you. KB retains the right to deny access to any person who fails to comply with these terms.
    
5. Security    
You are solely responsible in all respects for all use of and for protecting the confidentiality of any e-mail verification that may be given to you or selected by you for use on the website. You may not share these with or transfer them to any third parties. You must notify KB immediately of any unauthorised use of them or any other breach of security regarding the website that comes to your attention.

6.1 KB has used best endeavours to ensure that the website complies with UK laws. However, KB makes no representations that the materials on the website are appropriate or available for use in locations outside the UK. Those who visit the website from other locations do so on their own initiative and are responsible for compliance with all applicable laws. If the use of the website and/or viewing of it, or use of any material or content on the website or Services offered through the website are contrary to or infringe any applicable law in your jurisdiction(s), you are not authorised to view or use the website and you must exit immediately.  
6.2 KB makes no representations and gives no warranties, express or implied that making the Services available in any particular jurisdiction outside the UK is permitted under any applicable non-UK laws or regulations. Accordingly, if making the Services or any part available in your jurisdiction or to you (by reason of nationality, residence or otherwise) is prohibited, those Services are not offered for sale to you. You accept that if you are resident outside the UK, you must satisfy yourself that you are lawfully able to purchase the Services. KB accepts no liability, to the extent permitted by applicable law, for any costs, losses or damages resulting from or related to the purchase or attempted purchase of the Services by persons in jurisdictions outside the UK or who are nominees of or trustees for citizens, residents or nationals of other countries.

The contents of the website are protected by international copyright laws and other intellectual property rights. The owner of these rights is KB, its affiliates or other third-party licensors. All product and company names and logos mentioned in the website are the trademarks, service marks or trading names of their respective owners, including us. However, you may not modify, copy, reproduce, republish, upload, post, transmit or distribute, by any means or in any manner, any material or information on or downloaded from the website including but not limited to text, graphics, video, messages, code without KB’s prior written consent, except where expressly invited to do so, for example in order to complete any test or questionnaire.

KB makes no representations whatsoever about any other websites which you may access through the website or which may link to the website. When you access any other website, you understand that it is independent of KB and that KB has no control over the content or availability of that website. In addition, a link to any other website does not mean that KB endorses or accepts any responsibility for the content or the use of, such a website and KB shall not be liable for any loss or damage caused or alleged to be caused by or in connection with use of or reliance on any content, goods or services available on or through any other website or resource. Any concerns regarding any external link should be directed to its website administrator or webmaster.

9. Availability of the website
Availability of the website KB will try to make the website available but cannot guarantee that the website will operate continuously or without interruptions or be error-free and can accept no liability for its unavailability. You must not attempt to interfere with the proper working of the website and, in particular, you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, server, website, router or any other Internet connected device.

 

Section 2   Buying storytelling consultancy services from Keith Bound (KB)
    
1. Introductory – nature of this Agreement    
1.1 You may be buying on behalf of yourself or another individual, then the law identifies you as a ‘business’ and you have additional legal rights. You may be buying other than via the website. If so, these terms will apply to your purchase. 

 

2. Ordering
2.1 By placing an order, you warrant to KB that you are authorised to make a purchase on behalf you are acting, or, if you are buying as a business, you are capable of making a contract under the laws of England and Wales.    

2.2 KB does not have to accept an order placed by you. If your order is accepted, KB will confirm acceptance to you by online electronic means (‘Confirmation’) to the email address you have given on ordering.

3. Delivery  
3.1 Any times or dates stated for delivery are estimates only, KB will make all reasonable efforts to deliver storytelling consultancy services within the time specified but does not accept liability for any failure to deliver within that time.  
3.2 KB will make reasonable efforts to ensure the storytelling consultancy services are completed on an arranged time and date in a contract; however, KB cannot be held responsible if services need to be cancelled/rearranged due to illness, other cause or due technical fault by the third party.
3.3 It is your responsibility to provide client requirements, which have agreed time and date. If for any reason you need to cancel storytelling consultancy services during a contract period you will incur the full charges of the contract, which will need to be paid within 7 working days of cancellation.

4. Prices and Paying  
4.1 You must pay storytelling consultancy services as instructed in the contract.
4.2 Prices payable are those prices in force at the date and time of your order. KB may change the price of any storytelling consultancy service after you have seen the price on the website but before you place an order. 
 
5. Cancelling - General  
5.1 Once KB has recorded your order for storytelling consultancy services you will have no right to cancel the agreement made under these terms.

6. Refund Policy 
 Storytelling consultancy services are carried out to the best of the ability of KB  
(i) KB will take no responsibility or accountability legally or otherwise for the following.    
(ii) Any loss damage or medical issue from advice given. If you choose to follow the advice it is understood that it is at your will.   (iii) Any technical problems with storytelling consultancy services.    
 (iv) Any cancellation due to technical or unforeseen circumstances.    

 

7. Exclusions and limitations of Liability  
7.1 KB promises that for storytelling consultancy service you purchase:  
(i) KB has the right to sell the Services to you.
(ii) each Service will correspond with the description in the contract, and
(iii) each Service will be of satisfactory quality.  
7.2 KB also promises that any Service KB provides to you will be provided with reasonable skill and care.    
7.3 Except as stated in this clause, KB excludes all other express or implied terms, conditions, warranties, representations or endorsements whatsoever with regard to any storytelling consultancy service purchased as a result of access to the website or any information or service provided through the website  
7.4 KB will endeavour to ensure that all materials and information published on the website are accurate, but please note that all content, materials, and information on the website are provided on an ‘as is’ basis and you assume total responsibility and risk for your use of the website and use of all information contained within it.  
7.5 KB accepts no liability for any indirect or consequential loss or damage, or for any loss of data (whether direct or indirect) in each case, however, caused, even if foreseeable. In circumstances where you suffer loss or damage arising out of or in connection with the viewing, use or performance of the website, its contents or the material or information contained in a Product, KB accepts no liability for such loss or damage.  
7.6 The limitations and exclusions in this clause are not intended to affect your non-excludable statutory rights if you are buying as a consumer and they shall only apply to the extent permitted by applicable law.

 

8. General  
8.1 KB may assign, transfer, novate or subcontract any or all of KB’s rights and obligations under the Agreement at any time.  
8.2 KB may alter these terms from time to time and post the new version on the website, following which all use of the website will be governed by that version.    
8.3 These terms together with any order form and instructions regarding payment methods are the whole Agreement between you and KB. You acknowledge that you have not entered into this Agreement in reliance upon any statement, warranty or representation made by KB or any other person and you irrevocably and unconditionally waive any rights to claim damages and / or to rescind this Agreement by reason of any misrepresentation (other than a fraudulent misrepresentation) that is not contained in the terms, privacy policy, order form and payment method instructions.  
8.4 If any provision or term of the Agreement shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the other terms and conditions and shall be deemed to be deleted from them.  
8.5 The Agreement is governed by English law and you submit to the non-exclusive jurisdiction of the English court.  
8.6 Except in respect of a payment obligation, neither you nor KB will be held liable for any failure to perform any obligation to the other due to causes beyond your or KB’s respective reasonable control.  
8.7 Failure or delay by either party enforcing an obligation or exercising a right under these terms does not constitute a waiver of that obligation or right.  
8.8 These terms do not confer any rights on any person or party (other than you and / or KB) pursuant to the Contracts (Rights of Third Parties) Act 1999.
